General Conditions of Sale

1. Purpose

These General Conditions of Sale (hereinafter the "GCS") govern the contractual relations between the company American Cellar, operating the site american-cellar.com(hereinafter "the Site"), and any natural or legal person (hereinafter "the Customer") wishing to make a purchase via the Site.

3. Products

American Cellar offers for sale authentic American food products, imported or manufactured under license. The products offered are described and presented with the greatest possible accuracy. However, photographs are not contractually binding.

All products are offered while stocks last. In the event of unavailability, American Cellar undertakes to inform the Customer and offer a refund or exchange if the Customer ordered while the stock was empty.

4. Price

Prices are listed in euros (€), inclusive of all taxes (TTC), excluding delivery charges. American Cellar reserves the right to change its prices at any time, but products will be invoiced based on the rates in effect at the time the order is validated.

5. Order

The order is validated once payment has been accepted. Any order implies acceptance of the prices and descriptions of the products available for sale.

American Cellar reserves the right to refuse an order in the event of a prior dispute with the Customer, suspicion of fraud or any other legitimate reason.

7. Allergies and product information

The products offered on the Site may contain or have been in contact with allergens (gluten, peanuts, nuts, soy, milk, etc.).
All information and ingredients are listed on each product sheet. Boxes come with a summary sheet for each product in the box. It is the customer's responsibility to check this information before consuming.
The Company cannot be held responsible in the event of an allergic reaction linked to a product ordered on the Site.

8. Payment

Payment is made online via secure means: credit card, PayPal, or any other means offered on the Site. The order will only be shipped after actual receipt of payment.

9. Delivery

The products are delivered to the address indicated by the Customer when ordering. Delivery times are given as an indication and do not constitute a firm commitment. During peak periods (for example, Christmas), American Cellar undertakes to notify the customer via the Site of probable delivery delays. In the event of a prolonged delay, the Customer may request cancellation of the order and a refund.

Shipping costs are specified at the time of ordering. American Cellar is not responsible for any loss, delay, or damage caused by the carrier.

10. Right of withdrawal

In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of his order to exercise his right of withdrawal, except for perishable goods (food products), which are neither returned nor exchanged, in accordance with Article L221-28 of the Consumer Code. Here, the products will not be returned or exchanged because American Cellar sells food products.

12. Legal guarantees

The products sold benefit from the legal guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

13. Liability

American Cellar shall not be liable for any indirect damages related to the use of the Site or the purchase of products. The company's liability is in any event limited to the amount of the order.

14. Intellectual Property

All elements of the Site (texts, images, logos, videos, etc.) are the exclusive property of American Cellar or its partners. Any reproduction or use without authorization is strictly prohibited.

15. High

American Cellar is committed to complying with current regulations regarding the protection of personal data (GDPR). The Customer has the right to access, rectify, delete, and oppose their personal data.

16. Applicable law and disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought. Failing this, the competent court will be that of the defendant's domicile or the place of delivery.

Acceptance of the conditions

By validating his order, the Customer declares to have read and accepted without reservation these General Conditions of Sale.
